The Supreme Court was firm in its rejection of the Texas lawsuit yesterday, making it clear that it wouldn't hear the case. But why did the justices punt on this particular case?
In a previous case that pitted Nebraska against Colorado over legalizing recreational marijuana, Justices Thomas and Alito argued that the Supreme Court was obligated to hear cases that involved disputes between states.
And most legal scholars agree with that opinion, pointing out that the very reason the court was created was to settle constitutional disputes between the states. It's called original jurisdiction, and nothing in the Constitution or federal law allows the Supreme Court to ignore its duty involving cases that only it can hear.
And in this case, Alito and Thomas echoed their previous assertion that the court should have accepted the case. However, they also argued that they saw no merit to Texas' legal claims.
